1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between Splendid Plumbing Services (ABN: 67 141 758 387) (“Company”, “we”, “us”, or “our”) and you (“Customer”, “you”, or “your”). By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Services
2.1 Scope of Services
We provide professional plumbing services including but not limited to:
- General plumbing repairs and maintenance
- Emergency plumbing services
- Hot water system installation and repairs
- Blocked drain clearing
- Leak detection and repair
- Bathroom and kitchen renovations
- Toilet repairs and installation
- Tap repairs and replacements
- Water filtration system installation
2.2 Service Standards
All work will be performed:
- By licensed and qualified tradespeople
- In accordance with Australian Standards and relevant codes
- In compliance with Queensland plumbing regulations
- With appropriate permits where required
3. Quotations and Pricing
3.1 Quotations
- Written quotes are valid for 30 days unless otherwise specified
- Quotes are based on information provided and site conditions at time of inspection
- Additional work discovered during service delivery will be quoted separately
- We reserve the right to revise quotes if site conditions differ from those originally assessed
3.2 Pricing
- All prices quoted exclude GST unless stated otherwise
- Emergency and after-hours services attract additional charges
- Travel charges may apply for locations outside standard service areas
- Minimum service charges apply
4. Payment Terms
4.1 Payment Requirements
- Payment is due upon completion of work unless alternative arrangements are agreed in writing
- We accept cash, credit card, debit card, and electronic transfer
- Commercial accounts may apply for 30-day payment terms subject to approval
4.2 Late Payment
- Overdue accounts will incur interest at 2% per month
- We reserve the right to engage debt collection services for overdue accounts
- All collection costs will be borne by the Customer
5. Booking and Cancellations
5.1 Appointments
- We will endeavour to attend appointments at agreed times
- A 2-hour arrival window applies to standard bookings
- Delays due to circumstances beyond our control will be communicated promptly
5.2 Cancellations
- Cancellations must be made at least 2 hours before scheduled appointment
- Cancellations with less than 2 hours notice may incur a callout fee
- Failure to provide access at appointed time will incur a callout fee
6. Warranties and Guarantees
6.1 Workmanship Warranty
- We warrant our workmanship for 6 years from completion date
- This warranty covers defects in workmanship only
- Warranty does not cover normal wear and tear or misuse
6.2 Parts and Materials
- Manufacturer warranties apply to all parts and materials supplied
- We will assist with warranty claims but are not responsible for manufacturer warranty terms
6.3 Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the Australian Consumer Law and other applicable consumer protection laws.
7. Liability and Indemnification
7.1 Limitation of Liability
To the maximum extent permitted by law:
- Our liability is limited to re-performance of defective services or refund of service fees
- We are not liable for consequential, indirect, or special damages
- Our total liability will not exceed the value of services provided
7.2 Indemnification
You agree to indemnify us against all claims, losses, damages, and expenses arising from:
- Your breach of these Terms
- Your negligence or wilful misconduct
- Pre-existing defects or conditions not disclosed to us
8. Health and Safety
8.1 Site Safety
- You must ensure safe access to work areas
- All known hazards must be disclosed before work commences
- We reserve the right to cease work if unsafe conditions exist
8.2 Asbestos and Hazardous Materials
- Additional charges apply for work involving asbestos or hazardous materials
- Specialist contractors may be required at your expense
- All work will comply with relevant safety regulations
9. Insurance
We maintain:
- Public liability insurance of $20 million
- Professional indemnity insurance
- Workers compensation insurance You are responsible for maintaining adequate property insurance.
10. Privacy
We collect and handle personal information in accordance with the Privacy Act 1988 (Cth). Our privacy practices include:
- Only collecting information necessary for service delivery
- Not disclosing information to third parties except as required by law
- Maintaining appropriate security measures
11. Dispute Resolution
11.1 Internal Resolution
Any disputes should first be raised with our office by calling 0400 007 064
11.2 External Resolution
If disputes cannot be resolved internally, parties agree to attempt mediation before pursuing legal action
11.3 Jurisdiction
These Terms are governed by the laws of Queensland and parties submit to the exclusive jurisdiction of Queensland courts
12. Emergency Services
12.1 Emergency Callouts
- Emergency services are available 24/7
- Emergency rates apply outside standard business hours
- Priority given to situations involving immediate danger or property damage
12.2 Temporary Repairs
Emergency callouts may involve temporary repairs with permanent solutions quoted separately
13. Intellectual Property
All drawings, specifications, and advice provided remain our intellectual property and must not be used or disclosed without written consent.
14. Compliance and Certification
14.1 Regulatory Compliance
All work will be completed in accordance with:
- Plumbing Code of Australia
- AS/NZS 3500 Plumbing and drainage standards
- Queensland plumbing legislation and regulations
- Local government requirements
14.2 Certificates of Compliance
Where required, Certificates of Compliance will be issued upon completion and payment
15. General Provisions
15.1 Entire Agreement
These Terms constitute the entire agreement between parties and supersede all prior agreements
15.2 Amendments
We may update these Terms at any time by posting revised terms on our website
15.3 Severability
If any provision is invalid or unenforceable, remaining provisions continue in full force
15.4 Waiver
No waiver of any term is effective unless in writing and signed by the party waiving the right
15.5 Force Majeure
Neither party is liable for delays or failures due to circumstances beyond reasonable control
